COPYRIGHT POLICY AND TAKEDOWN REQUESTS

It is against our Terms and Conditions for users to publish any content that violates privacy rights, publicity rights, copyrights, or contract rights. We will immediately remove a document at your request in the case of either of the following:

  • You hold a copyright to a document uploaded to EduNinja by an unauthorized 3rd party
  • Your personal/private information is contained within a document uploaded to EduNinja by an unauthorized 3rd party

HOW TO SUBMIT A TAKEDOWN REQUEST

To issue a takedown request, send an email to service@eduninja.net. Ensure that your request complies with all the requirements of the DMCA (see below). Our team will review your submission and take appropriate action within 24-48 hours.

We are committed to protecting intellectual property rights and will respond promptly to valid copyright infringement claims. All takedown requests are handled with the utmost care and confidentiality.

DMCA TAKEDOWN REQUIREMENTS

Per the Digital Millennium Copyright Act (DMCA, see 17 U.S.C 512(c)(3) for details), we require the following information in writing for DMCA takedown requests:

  1. Electronic or Physical Signature: An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright's interest.
  2. Description of Copyrighted Work: A description of the copyrighted work that you claim has been infringed, including the URL of the location where the copyrighted work exists, or a copy of the copyrighted work.
  3. Location of Infringing Material: Identification of the URL or other specific location on the service where the material that you claim is infringing is located.
  4. Contact Information: Your address, telephone number, and email address.
  5. Good Faith Statement: A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy Statement: A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

COUNTER-NOTIFICATION PROCESS

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with us. To be effective, a counter-notification must be a written communication provided to our designated agent that includes substantially the following:

  1. Your physical or electronic signature
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled
  3. A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled
  4. Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located

REPEAT INFRINGER POLICY

EduNinja has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the Services and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

FAIR USE AND EDUCATIONAL CONTENT

EduNinja is committed to supporting educational use of materials. We recognize that certain uses of copyrighted material may qualify as fair use under copyright law, particularly in educational contexts. However, we also respect the rights of copyright holders and will remove content when we receive valid takedown notices.

If you believe your use of copyrighted material falls under fair use or other exceptions to copyright law, you may include this information in your counter-notification. We encourage users to familiarize themselves with fair use principles and to use copyrighted materials responsibly.

RESPONSE TIME AND PROCESS

Upon receipt of a valid DMCA takedown notice, we will:

  1. Acknowledge receipt of your notice within 24 hours
  2. Review the notice for completeness and validity
  3. Remove or disable access to the allegedly infringing material if the notice is valid
  4. Notify the user who posted the material of the removal
  5. Provide the user with information about the counter-notification process

We aim to process all valid takedown requests within 48 hours of receipt. Complex cases may require additional time for review.

FALSE CLAIMS AND PENALTIES

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. This includes both false takedown notices and false counter-notifications.

We reserve the right to seek damages from any party that submits a false or fraudulent takedown notice or counter-notification. Before submitting a notice, please ensure that you have a good faith belief that the use of the material is not authorized by the copyright owner.

OTHER INTELLECTUAL PROPERTY RIGHTS

While this policy primarily addresses copyright infringement, EduNinja also respects other intellectual property rights, including trademarks, patents, and trade secrets. If you believe that content on our platform infringes your non-copyright intellectual property rights, please contact us at service@eduninja.net with details of your claim.
